Official Rules for the “Find the Freightliner” Calendar Contest

1. To enter the Contest, complete an online entry form in the manner listed below during one or more of the monthly promotion periods beginning 12:01 a.m. Eastern Time on the first day of each month, through 11:59 p.m. Eastern Time on the last day of each month, starting January 1, 2013 and ending December 31 2013.

2. Eligibility. The Contest is offered and is open only to legal residents of the 50 United States, the District of Columbia, who are natural persons age 18 and older. Employees of Daimler Trucks North America LLC (“Sponsor”), affiliated companies, dealers, agents, advertising and promotion agencies and their employees, and the immediate family members or persons living in the same household of such employees are not eligible to enter. The Contest is subject to all federal, state, and local laws and regulations. Offer void where prohibited or otherwise restricted.

3. Entry by Online Registration Only. To enter Contest, access either the www.findthisfreightliner.com or www.freightlinertrucks.com/2013Calendar websites (the “Websites”), and click on the icon, banner, or link to be taken to the registration page, completely fill out the entry form and correctly answer the multiple choice question about the location of the truck depicted on the Freightliner calendar for that month. No other attempted methods of entry will be accepted. Entries limited to one registration per person per valid email address per month. Multiple entries by the same person or using the same email address will be disqualified.

4. Prize Details. The following prizes will be awarded for the Promotion Period listed below. All prizes listed are less than $25.00 in value. Prizes are provided “as is” and without any warranty of any kind. Prizes are not transferable and are not redeemable for cash or for credit. Sponsor reserves the right to substitute a prize of equal or greater value if stated prize becomes unavailable for any reason:

August: Branded keychain

5. Awarding of Prizes. The first twenty-five (25) registered entries received during each month’s promotion period that correctly identify the location of the truck as requested by the Website will win a prize. The potential winners will be notified by phone or email. Prize winners will be announced shortly after 25 correct entries have been received and the eligibility of each potential winner can be verified, at which point the Contest will be closed for that Promotion Period. Acceptance of a prize constitutes each winner’s acknowledgement that they have complied with the Official Rules, and winner’s consent to the use of his/her full name and/or photograph without further compensation for advertising, promotional and publicity purposes by Sponsor. If any prize notification or attempted notification is returned as undeliverable, the prize will be forfeited and may be awarded to an alternate winner.

6. Odds. Prizes will be awarded only to the first 25 eligible entries received for each monthly promotion period.

7. Use of Data/Privacy. Sponsor will be collecting personal data about participants online in accordance with its privacy policy. Please review Sponsor’s Privacy Policy Legal Notices and Terms at http://www.daimler-trucksnorthamerica.com/privacy.html for details. By participating in this Contest, participants hereby agree to Sponsor’s collection and usage of their personal information and acknowledge they have read and accepted Sponsor’s privacy policy.

8. Taxes. Any valuation of the prizes stated above is based on available information provided to the Sponsor, and the value of any prize awarded to a winner may be reported for tax purposes as required by law. Winners are solely responsible for reporting and paying any and all applicable taxes.

9. General Conditions and Limitation of Liability. By participating in this Contest, participants agree to be bound by the Official Rules and the decision of the Sponsor. Limit one entry per person/authorized email account holder for each monthly Promotion Period. All entries become property of the Sponsor and will not be returned. All federal, state, and local laws and regulations apply. Sponsor reserves the right, at its sole discretion, to cancel, terminate, modify or suspend this Contest or any portion thereof, or to disqualify any individual implicated in any of the following actions, if for any reason (a) infection by computer virus, bugs, tampering, unauthorized intervention, actions by entrants, fraud, technical failures, or any other causes which in sponsors’ sole opinion, corrupt or affect the administration, security, fairness, integrity or proper conduct of the Contest, (b) the Contest or any website associated therewith (or any portion thereof) becomes corrupted or does not allow the proper processing of entries per these rules, or (c) the Contest is otherwise not capable of running as planned by Sponsor. By entering, participants agree to release and hold harmless, Sponsor, Administrator, any prize suppliers and each of their parents, subsidiaries, affiliates, divisions, advertising and promotional agencies, wholesalers and retailers, and each of the foregoing entities employees, offices, directors, shareholders and agents (collectively the Released Parties”) from and against any and all claims, actions and/or liability for any injuries or death, loss or damage of any kind arising from or in connection with participation in and/or entry into the Contest or acceptance or use of any prize or participation in any Contest related activity and for any claims based on publicity rights, defamation, invasion of privacy and merchandise delivery. The Released Parties are not responsible or liable for any incorrect or inaccurate entry information , and assume no responsibility for (i) any error, omission, interruption, defect or delay in operation or transmission at any website, (ii) failure of any entry to be received by Sponsor due to technical problems, human error, or traffic congestion on the internet or any website, (iii) communications line, hardware and/or software failures, (iv) damage to any computer (software or hardware) resulting from participating in the Contest, (v) theft or destruction of, tampering with, unauthorized access to, or alteration of entries and or entry information, or (vi) entries which are late, lost, stolen, damaged, illegible, unintelligible and or postage due (or any combination thereof). The use of third-party software or website or automated entry systems to participate is prohibited, and Sponsor reserves the right to disqualify entries made in such fashion. By entering, entrants agree to comply with these rules. Any entrant who attempts to tamper with this Contest in any way shall be disqualified. In the event of dispute as to who submitted an online entry, the entry will be deemed submitted by the Authorized Account Holder of the email address submitted at the time of entry. “Authorized Account Holder” is defined as the natural person assigned to an email address by an internet access provider, on-line service provider, or other organization responsible for assigning email addresses for the domain associated with the email address in question. Additional restrictions may apply.

10. Dispute Resolution/Choice of Law. Except where prohibited, participants agree that: (1) any and all disputes, claims, and causes of action arising out of or connected with this Contest, or any prize(s) awarded, or the determination of the winners, shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate state or federal courts located in Portland, Multnomah County, Oregon, and (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest but in no event attorneys' fees; and (3) under no circumstances will participant be permitted to obtain awards for, and participant hereby waives all rights to claim, punitive, incidental, and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of participant and/or Sponsor in connection with the Contest, shall be governed by, and construed in accordance with the laws of the State of Oregon, without regard for the conflicts of law doctrine of that State or any other jurisdiction, and all proceedings shall take place in the State of Oregon.
